This Privacy Policy describes how Basketouch Solutions Spain, S.L. (hereinafter, “Basketouch”, “we” or “the Company”) processes personal data in relation to the website basketouch.com and the digital products marketed under our brands (CutSports, DrawSports, Zouch, BasketSets and related services).

2. Scope
This policy applies to:
- Browsing basketouch.com and its contact forms.
- Mac products marketed by Basketouch (CutSports, CutSports Pro, BasketSets and bundles), including license activation and support.
- iOS/iPad apps with their own policy under /en/apps/{slug}/privacy/ (e.g. Zouch, DrawSports).
- DrawSports PRO, its web panel and related team services, when they require a user account (in addition to the app-specific policy).
- Business and support communications initiated with Basketouch.
Product sites may include complementary information (for example, cutsports.app/privacy-policy).
3. Data we collect
Depending on the service you use, we may process:
- Identification and contact data: name, email address, organization or club, phone number (if you provide it).
- License data (Mac products): activation email and machine (Mac) identifier needed to validate the subscription.
- Account data (DrawSports PRO / panel): login credentials, user profile, team configuration and data needed to provide the contracted service.
- Payment data: processed by Paddle (Mac products in our own channel) or Apple (DrawSports on the App Store). Basketouch does not store full card numbers or sensitive banking data.
- Waitlist and communications: name and email when you sign up to receive updates (for example, the CutSports launch), managed through providers such as Brevo.
- Website technical data: IP address, browser type, pages visited, technical cookies (see the Cookie Policy).
- Support: the content of the messages you send us and associated metadata (date, product, purchase email).
Sports content: videos, analysis projects, diagrams and exports created with our applications are generally stored on the user's device. Only minimal data is transmitted when necessary for an explicit feature (license activation, PRO sync, user-initiated transfer, etc.).
4. Purpose and legal basis
- Providing the contracted service — performance of a contract (Art. 6.1.b GDPR): license activation, PRO panel access, technical support.
- Payment and subscription management — performance of a contract and legal obligations (Art. 6.1.b and 6.1.c GDPR).
- Transactional communications (purchase confirmation, renewal, activation instructions) — performance of a contract (Art. 6.1.b GDPR).
- Waitlist and marketing — consent (Art. 6.1.a GDPR), when you sign up voluntarily; you can withdraw it at any time.
- Security, fraud prevention and product improvement — legitimate interest (Art. 6.1.f GDPR), limited to what is strictly necessary and, where applicable, in aggregated or anonymized form.
- Legal compliance — legal obligation (Art. 6.1.c GDPR): invoicing, claims, requirements from authorities.
5. Recipients and data processors
We may share data with the following types of recipients:
- Paddle.com Market Limited — payment processor and Merchant of Record for Mac products in our own channel.
- Apple Inc. — distribution, billing and subscription management for DrawSports on the App Store.
- Supabase, Inc. — database infrastructure for Mac licenses and PRO accounts (servers within the European Union when the project configuration sets it).
- Brevo — contact management and marketing/waitlist email sending.
- Vercel Inc. — website hosting and serverless functions.
- Resend or other transactional email providers — sending operational emails after purchase or activation.
- Professional advisors (legal, tax) when there is a documented obligation or legitimate interest.
We do not sell personal data to third parties or share it for advertising purposes unrelated to those described here.
Some data processors may be located outside the European Economic Area. In such cases we apply appropriate safeguards (standard contractual clauses, adequacy decisions or other measures recognized by the GDPR).
6. Retention periods
- Active account and license: for as long as the contractual relationship and use of the service continue.
- After cancellation: non-mandatory personal data is blocked and erased within a maximum of 30 days, unless retention is required by law.
- Billing data: up to 5 years (plus any additional periods required by Spanish tax regulations).
- Waitlist: until unsubscription, requested deletion or the end of the relevant campaign.
- Support: for as long as needed to resolve the issue and, where applicable, the statute-of-limitations period for liabilities.
7. Your rights
If you reside in the European Economic Area, you can exercise the following rights with Basketouch:
- Access to your personal data.
- Rectification of inaccurate or incomplete data.
- Erasure (“right to be forgotten”), where applicable.
- Restriction of processing.
- Objection to processing based on legitimate interest.
- Data portability, when technically possible.
- Withdraw consent at any time, without retroactive effect.
To exercise them, write to info@basketouch.com stating the right you wish to exercise and proving your identity when necessary. We will respond within a maximum of one month, extendable depending on the complexity of the case in accordance with the GDPR.
You can also file a complaint with the Spanish Data Protection Agency (AEPD).
For subscriptions managed by Apple, some rights can be exercised directly from your Apple ID settings or the App Store.
8. Minors
Our services are aimed at sports professionals and organizations. We do not knowingly collect data from minors under 14. If we discover we have received data from a minor without valid parental or guardian consent, we will proceed to delete it.
9. Security
We apply reasonable technical and organizational measures: encryption in transit (HTTPS/TLS), access controls, environment segregation and periodic review of critical providers. No system is completely infallible; we recommend using strong passwords and keeping your devices up to date.
10. Changes to this policy
We may update this Privacy Policy to reflect legal or product changes. We will publish the current version on basketouch.com with its update date. If changes are substantial, we will notify you by email or through a visible notice in the affected product when we have your contact details.
