SPECIFIC TERMS OF USE FOR "DRAWSPORTS" APP

End User License Agreement (EULA): The use of the DrawSports application is governed by the standard Apple Licensed Application End User License Agreement. By downloading and using the app, you agree to these terms. You can access the full agreement here: https://www.apple.com/legal/internet-services/itunes/dev/stdeula/

1. Parties and identification

These Terms and Conditions (hereinafter, “the Terms”) govern access to and use of the website basketouch.com and establish the general framework applicable to the digital products marketed by Basketouch Solutions Spain, S.L. (Tax ID CIF B52575107, registered at C/ Padre Arintero, 17 — 33403 Avilés, Asturias, Spain).

By accessing basketouch.com or purchasing a Basketouch product, you confirm that you have read and accepted these Terms, the Legal Notice, the Privacy Policy, the Cookie Policy and, where applicable, the Refund Policy.

2. Products and specific conditions

Basketouch markets different products under its own brands. Each one may have additional conditions:

• DrawSports (iPad, App Store): governed by the standard Apple EULA stated at the beginning of this document and by Apple's policies for in-app purchases and subscriptions.
• CutSports / CutSports Pro / BasketSets (Mac): detailed conditions at cutsports.app/terms-of-service, complementary to these Terms.
• DrawSports PRO (teams): subject to the contracted agreement or plan; see drawsports.app/pro.

In case of conflict between these general Terms and a product's specific conditions, the specific conditions will prevail with respect to that product.

3. Use of the basketouch.com website

• The Site has an informational and corporate purpose: presenting the Company, its products and legal documentation.
• You agree not to use the Site for unlawful or fraudulent purposes, or in a way that infringes third-party rights.
• Unauthorized access to systems, reverse engineering of the Site, or interference with its availability is not permitted.

4. Software licenses

Unless expressly stated otherwise, Basketouch grants the user a personal, limited, non-exclusive, non-transferable and revocable license to use the purchased software in accordance with the plan acquired (number of devices, subscription type, etc.).

Unless authorized in writing by Basketouch, it is expressly prohibited to:

• Copy, modify, decompile or reverse engineer the software.
• Resell, sublicense, rent or transfer the license outside the scope of the plan.
• Use the software to develop a substantially similar competing product.
• Circumvent activation mechanisms, license controls or technical limitations.

5. User content

The user retains ownership of the videos, projects, diagrams and other materials they import or generate with Basketouch applications. The user is responsible for holding the necessary rights over such content (recordings, third-party images, minors' data, etc.).

Basketouch does not monitor content stored locally on the user's device, except when the user uses features that involve voluntary data transmission (support, PRO panel, transfers, etc.).

6. Prices, payments and billing

• Current prices for each product are published on its sales site (cutsports.app, App Store, drawsports.app/pro, etc.) and include applicable taxes depending on the channel and territory.
• Mac subscriptions in our own channel are processed by Paddle as Merchant of Record. DrawSports subscriptions on the App Store are processed by Apple.
• Automatic renewals, cancellations and invoices are managed according to the rules of the relevant purchase channel.

7. Trial period (Mac products)

When CutSports Pro or another Mac product offers a trial period, its conditions (duration, payment method requirement, conversion to a paid subscription) will be shown at checkout and on cutsports.app/pricing. You can cancel before the trial ends to avoid being charged, as described in the Refund Policy.

8. Availability and updates

Basketouch strives to keep its services operational but does not guarantee uninterrupted availability. We may release software updates that improve security or functionality; some may be required to keep using the service.

9. Limitation of liability

Basketouch tools provide technical and tactical support. We do not guarantee specific sporting results. To the extent permitted by applicable law, Basketouch's total liability for damages arising from use of the Site or its products is limited to the amount paid by the user for the affected product in the 12 months prior to the event giving rise to the claim, except in cases of willful misconduct, gross negligence, or where mandatory consumer regulations do not allow such a limitation.

10. Termination and suspension

Basketouch may suspend or terminate access to a service if the user breaches these Terms, a product's conditions, or uses the software fraudulently or abusively. Termination does not exempt the user from paying amounts owed before the effective date.

11. Modifications

We may update these Terms due to legal or product changes. The version published on basketouch.com with its update date will prevail. For active subscribers, we will notify substantial changes when reasonably possible.

12. Governing law and jurisdiction

These Terms are governed by Spanish law. Unless mandatory consumer regulations apply, the parties submit to the Courts of Avilés (Asturias).
